TERMS AND CONDITIONS OF THE SERVICE |
| On one hand idiomax.net ®, and on the other hand the user, they agree hereby the terms and conditions that will govern the benefit of this service of private online spanish lessons, summarized in the following points: 1 - The submission by the user of the form requesting the spanish lessons to idiomax.net® , means the acceptance by the user of these terms. 2 - The service is based on direct communication between the user and teacher by means of a software of instantaneous messaging that allows the phone communication from pc to pc. This service can be "windows live messenger" or "Skype" , as the user choices. The user must have installed this messaging software in the pc which will receive the lessons and he must be familiarized with its handling and operation. It won't be responsibility of idiomax.net® the nonfulfillment by the user of this condition. 3 - The user will also be familiarized with the handling and operation of Windows, as well as the Internet browsers (Windows Internet Explorer, Mozilla Firefox, Netscape) and with the use of the e-mail. It won't be responsibility of idiomax.net® the nonfulfillment by the user of this condition. 4 - The schedules of the lessons will be agreed between the user and idiomax.net ® according to the time zone where the user is, and to available teachers. The acceptance by the user of the agreed scheduled lessons program, means the commitment to accomplish with it. 5 - idiomax.net ® will elaborate a schedule program of classes with the number of hours that the user wants to take, being its execution respected insofar as possible. In the case that some scheduled lesson could fail due to the user´s attributable causes (*1), idiomax.net® will try to postpone the fail lesson according to the teachers availability, making all the possible in order to the user don´t lose any paid lesson, but idiomax.net® doesn't guarantee it. The scheduled lessons that will fail due to user´s attributable causes will not be refunded. 6 - in the case that some lesson could fail due to idiomax.net® attributable causes (*2), the user will be able to take one of the following choices a) Postpone the lesson to other day b) To be refunded for the amount of the fail lesson (*3) The user must communicate to idiomax.net® by e-mail the taken option within the six hours after the failed lesson. If the user do not communicate to idiomax.net his choice in term, idiomax.net® will allow the recovery of the fail lesson, but not the money refund. (1 *) they are considered attributable causes to the user the following ones: a) - not to be connected and identified accurately by means of the agreed messaging service at the scheduled day and time or doing that delayed more than fifteen minutes for any reason. b) - Shortcomings or interruptions in the connection due to attributable causes to the supplier of the user's Internet. c) - Any problem about hardware or software in the user's Pc,. (2 *) they are considered attributable causes to idiomax.net® the following ones: a) - not to be connected and identified accurately by means of the agreed messaging service at the scheduled day and time or doing that delayed more than fifteen minutes for any reason. b) - Shortcomings or interruptions in the connection due to attributable causes to the supplier of the teacher's Internet. c) - Any problem about hardware or software in the teacher's Pc,. (*3) The only case in which idiomax.net® refunds money is in the case that some lesson could fail due to causes attributable to idiomax.net® The user must be registered as Paypal user in order to be refunded , because idiomax.net® only refunds for means of Paypal. More information about these transactions in http://www.paypal.com 7 -The first lesson is free and it does not require any commitment to the user. This first lesson takes around 20 minutes, having the following goals: - To get the meeting of teacher and user. - Let idiomax.net® to evaluate the user spanish level in order to elaborate the lessons program (if the user decides to continue with the lessons) . - Let idiomax.net® to evaluate how the user knows the software for the development of the lessons (Windows, e-mail, Internet browser, Skype, Windows Live…) In this case, if idiomax.net® considers that the user presents a deficient handling, idiomax.net® can refuse the payment by the user for later lessons. - Let the user to evaluate the teaching quality and the good operation of the system, so the user can decide to buy or not lessons. 8 - The purchase of lessons by the user after the first free lesson means the user is satisfied with the service, with the teacher and with the teaching system. The user can buy lessons starting from 3 hours up to 20 hours. The lessons can last from a minimum of half an hour up to a maximum of one hour and a half. 9 - The payments for lessons must be made in advance. Idiomax.net® will not give lessons that not have been previously paid by the user. The confirmation of a payment takes only some minutes, but it is recommended to make the payments at least 24 hours before the lessons. The payments are valid for 45 days. Schedules must keep in mind this term . The paid lessons should be taken inside this term or they will get lost. 10 - After each lesson, the user will receive by e-mail a report about made payments, received lessons and remaining lessons. If the user is satisfied with the service and he wants to continue studying with idiomax.net®, the user can buy as often as he wants more time of lessons, by requesting to the teacher. 11 - When the user wants to buy lessons, he just needs to communicate that to the teacher and idiomax.net® will send to the user´s email address a payment request . The user only has to click on the link that appears in our payment request and to follow the steps that appear in the screen. Payment are made in Paypal´s web site by means of credit cards or Paypal Account. It is completely safe, being Paypal who provide the security required in this type of transactions. It is not necessary for the user to be registered as Paypal user, but it is advisable, especially in the cases of refunds (please read the point 6th of the present conditions). 12 - Each lesson means the total acceptance of previous lessons by the user, The fact of receiving new lessons (independently of the payments that the user have made) is a proof of satisfaction with the service, with the teacher and with the teaching system. Any complain can be made by the user to idiomax.net® by writing to the following e-mail address: info@idiomax.net 13 - Everything that is written during the lessons will be recorded by the teacher in Skype or Windows Live conversations records, for two reasons: - As a didactic tool resource. - As a proof that the lesson has been given. idiomax.net® won't use this recordings with other purposes . The user accepts that the lessons can be recorded for those purposes. 14 - The e-mail is the way of communication between idiomax.net® and the user for all the related with this service.
